Anti-Exploit Policy

This Policy exists to protect the integrity, security, and fair play of Sky Isles, our community, and our intellectual property. This Policy applies to any person or entity that:

1. accesses Sky Isles,
2. attempts to interfere with Sky Isles, or
3. develops, distributes, sells, markets, publishes, or otherwise provides any exploit, cheat, unauthorized script, tool, service, or circumvention technology targeting Sky Isles.

This Policy supplements any platform terms, experience rules, community guidelines, and other applicable terms governing your use of Sky Isles.

For purposes of this Policy:

"Exploit"

Any method, script, executor, injector, tool, modification, hardware, automation, or other technique that: (a) manipulates gameplay or systems in an unauthorized way; (b) bypasses intended progression, security, or economy controls; (c) changes client behavior to gain an unfair advantage; or (d) interferes with the normal operation, availability, or integrity of Sky Isles.

"Cheat"

Any Exploit used to confer an advantage or to obtain items, currency, progression, or outcomes not intended by gameplay design.

"Unauthorized Script"

Any code executed or injected in connection with Sky Isles that is not provided by Apex Games and not explicitly authorized in writing by Apex Games.

"Distribution"

Selling, reselling, licensing, renting, transferring, publishing, uploading, hosting, linking to, advertising, encouraging use of, providing access to, or otherwise making available (publicly or privately) an Exploit or Unauthorized Script, including through a repository, chat community, website, video, "tutorial," or paid subscription.

"Derivative Works"

Works based on Sky Isles or Sky Isles materials that recast, transform, or adapt Sky Isles assets, code, content, branding, or other protected elements without authorization.

"Gameplay Integrity Tools"

Technical measures used by us and/or platform providers to detect, prevent, limit, or respond to cheating, exploitation, automated gameplay, tampering, or other security risks.

Without limitation, you may not, and you may not attempt to:

• Develop, distribute, market, sell, license, or support any Exploit or Unauthorized Script targeting Sky Isles.
• Use any Exploit or Unauthorized Script in Sky Isles.
• Bypass, disable, tamper with, or circumvent Gameplay Integrity Tools, access controls, rate limits, server-side validations, or other security mechanisms.
• Reverse engineer, decompile, disassemble, scrape, or attempt to derive source code, logic, or proprietary systems associated with Sky Isles except to the extent expressly permitted by applicable law and with our prior written authorization.
• Evade enforcement by using alternate accounts, ban evasion techniques, spoofing, or any method intended to conceal identity, distribution, or use of Exploits.
• Interfere with operations including denial-of-service activity, economy disruption, item duplication, or abuse intended to degrade service availability, integrity, or player experience.
• Facilitate third-party violations by hosting, linking, promoting, brokering, or providing "support" for Exploits, including "how-to" content intended to enable cheating in Sky Isles.

To protect Sky Isles and our community, we may (where lawful and technically available):

• Monitor and log gameplay and system activity indicative of exploitation or tampering
• Retain security logs, moderation records, transaction/economy records, and other telemetry necessary to investigate abuse, prevent fraud, and protect integrity

We may preserve evidence of suspected violations, including relevant logs, timestamps, content locations (URLs), screenshots/videos, and communications that demonstrate distribution or monetization of Exploits.

We may take any action we deem appropriate, including without limitation:

• Warnings, kicks, temporary suspensions, or permanent bans
• Removal of in-game items, currency, or progress obtained through Exploits
• Technical countermeasures, patches, and rate limits
• Reporting to platform operators and service providers
• Requests for content removal, account termination, server takedowns, and payment disruption as permitted by applicable policies and law

If you host, publish, or distribute infringing copies, derivative works, or unauthorized distributions of Sky Isles assets/code/content (including exploit packages containing Sky Isles materials), we may pursue content removal through:

• DMCA notices to the relevant hosting provider(s)
• Platform enforcement channels
• Other lawful remedies

DMCA notices and counter-notices must be truthful. Knowingly false claims can create legal liability.

If we identify Exploit development, Distribution, or commercial Exploit activity targeting Sky Isles, Apex Games may issue cease-and-desist demands requiring immediate:

• Cessation of development, Distribution, marketing, and support
• Removal of the relevant content from all locations under your control
• Preservation of evidence and records
• Disclosure of distribution channels, reseller identities, and monetization pathways (where appropriate)

If you fail to comply, Apex Games may pursue civil action seeking, as available and appropriate:

• Temporary, preliminary, and permanent injunctive relief
• Impoundment, disablement, and/or destruction of infringing or circumvention devices, tooling, or content
• Monetary damages (including statutory or actual damages), disgorgement of profits, and recovery of costs and attorneys' fees where allowed by law
• Any other equitable or legal remedies available

Where Exploit activity involves willful, commercially motivated circumvention, trafficking, fraud, unauthorized access, or other behavior that may violate criminal law, Apex Games may refer matters to law enforcement and cooperate with investigations, including by providing preserved evidence and records where lawful.

Governing Law: This Policy, the use and operation of Sky Isles, and any dispute arising from or relating to Sky Isles exploitation, cheating, circumvention, Distribution of Exploits, unauthorized access, or any other violation of this Policy shall be governed by and construed in accordance with the laws of the State of Washington, United States of America, without regard to its conflict of law principles or the United Nations Convention on Contracts for the International Sale of Goods.

Venue and Jurisdiction: All legal proceedings arising out of or relating to this Policy shall be handled exclusively in the state and federal courts located in Washington State, United States. You irrevocably consent to the exclusive jurisdiction and venue of these courts and waive any objections based on inconvenient forum or lack of personal jurisdiction. Each party consents to service of process in any manner permitted by applicable law.

Severability: If any provision of this Policy is found by a court of competent jurisdiction to be invalid, unenforceable, or in violation of applicable law, such provision shall be reformed to the minimum extent necessary to make it enforceable, or if reformation is not possible, severed. All other provisions shall remain in full force and effect to the maximum extent permitted by law.

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Apex Games and its owners, officers, contractors, and representatives from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of this Policy, your Distribution of Exploits, or your interference with Sky Isles.

Sky Isles is provided on an "as is" and "as available" basis to the maximum extent permitted by law. To the maximum extent permitted by law, Apex Games disclaims all warranties, express or implied, and will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to Sky Isles or this Policy.

Nothing in this Policy excludes liability that cannot be excluded under applicable law.
