By creating an account, linking your Roblox account, accessing the Game, using the Website, or otherwise utilizing any of our Services, you expressly agree to be bound by these Terms, our Privacy Policy, and any additional guidelines, rules, or policies that may be posted on our platforms from time to time.

You must be at least 13 years of age to use our Services. If you are under 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of parental consent at any time.

Your use of Sky Isles on the Roblox platform is also subject to the Roblox Terms of Use and Community Standards. In the event of any conflict between these Terms and Roblox's terms, Roblox's terms shall take precedence with respect to your use of the Roblox platform, while these Terms shall govern your relationship with Apex Games specifically.

To access certain features of the Website, you may link your Roblox account using Roblox's OAuth 2.0 authentication system. When you authenticate via Roblox OAuth, we receive and store:

• Your Roblox User ID (a unique numerical identifier)
• Your Roblox username and display name
• Your Roblox account creation date
• Your Roblox avatar thumbnail URL
• Gamepass ownership status for Sky Isles gamepasses

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to:

• Not share your account access with any third party
• Immediately notify us of any unauthorized access or security breach
• Accept responsibility for all activities occurring under your account
• Ensure all information provided during registration is accurate and current

When you link your account, we verify your gamepass ownership status through Roblox's API. We do not synchronize in-game progress, statistics, or economy data. Your account on the Website serves solely for profile management and gamepass verification.

• Subscriptions are billed monthly and automatically renew unless cancelled

Subscriptions are generally non-refundable. Refunds may be provided at our discretion for technical errors, unauthorized charges, or significant service outages. Refund requests must be submitted within 14 days of the charge.

Certain subscription benefits (Discord roles, in-game chat tags) require manual delivery through our Discord support system. You must open a support ticket after subscribing to receive these benefits. Delivery typically occurs within 24-72 hours of your request.

By subscribing, you agree to our complete Subscription & Billing Agreement, which contains detailed terms regarding automatic renewal, cancellation, refunds, price changes, and benefit delivery.

You agree NOT to engage in any of the following:

If you witness or become aware of any violations of these rules, please report them through our official Discord server or by contacting us at legal@apexplatforms.com. We take all reports seriously and investigate them thoroughly.

We reserve the right to take any of the following enforcement actions for violations of these Terms, at our sole discretion and without prior notice:

• Warning: A formal notice of the violation
• Temporary Suspension: Restriction of access for a specified period
• Permanent Ban: Indefinite termination of access to all Services
• Data Wipe: Reset or removal of in-game progress and items
• Hardware/IP Ban: Blocking of device identifiers or network addresses
• Legal Action: Pursuit of civil or criminal remedies where appropriate

If you believe an enforcement action was taken in error, you may submit an appeal by emailing legal@apexplatforms.com with the subject line "Ban Appeal" and the following information:

• Your Roblox username and User ID
• Date of the enforcement action
• Detailed explanation of why you believe the action was incorrect
• Any evidence supporting your appeal

Appeals are reviewed within 14 business days. Our decision on appeals is final. Submitting false or misleading information in an appeal may result in additional penalties.

Violations on any of our platforms (Game, Website, Discord) may result in enforcement actions across all platforms. A ban from the Game may also result in restriction from the Website and Discord server, and vice versa.

• Follow all instructions from moderators and administrators
• Keep discussions in appropriate channels
• No spam, excessive caps, or disruptive behavior
• No NSFW content, regardless of channel
• No self-promotion or advertising without permission
• No discussion of exploits, hacks, or cheating methods
• Respect the privacy of other community members
• Report rule violations to moderators via the designated channels

Sky Isles, Apex Games, and all related names, logos, graphics, designs, game mechanics, code, and content are the exclusive property of Apex Games or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except for the limited license to use the Services as intended.

You retain ownership of any User-Generated Content you create. However, by submitting, posting, or displaying Content through our Services, you grant Apex Games a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content in connection with operating and promoting our Services.

If you believe that your copyrighted work has been infringed upon within our Services, please submit a DMCA takedown notice to legal@apexplatforms.com including:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APEX GAMES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

You agree to defend, indemnify, and hold harmless Apex Games and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

You may terminate your account at any time by discontinuing use of the Services and submitting an account deletion request to legal@apexplatforms.com. Upon termination, your right to access the Services will immediately cease.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

Upon termination, all licenses and rights granted to you under these Terms will immediately terminate. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

These Terms and any dispute arising from or relating to the Services shall be governed by and construed in accordance with the laws of the State of Washington, United States of America, without regard to its conflict of law principles or the United Nations Convention on Contracts for the International Sale of Goods.

All legal proceedings arising out of or relating to these Terms shall be handled exclusively in the state and federal courts located in Washington State, United States. You irrevocably consent to the exclusive jurisdiction and venue of these courts and waive any objections based on inconvenient forum or lack of personal jurisdiction.

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the state or federal courts of Washington State.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND APEX GAMES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unenforceable, or in violation of applicable law, such provision shall be reformed to the minimum extent necessary to make it enforceable, or if reformation is not possible, severed. All other provisions shall remain in full force and effect.
